By accessing or using Suvihim's services, including our FaydaMX platform, website, mobile applications, WhatsApp Business communications, or IVR services, you agree to be bound by these Terms & Conditions and our Privacy Policy.

If you do not agree to these terms, please do not use our services.

Platform Services

Suvihim provides a SaaS-enabled loyalty and commerce platform that includes:

  • Customer engagement solutions

FaydaMX Application

Our flagship mobile application connects consumers with local merchants, enabling:

  • Discovery of local businesses and offers
  • Loyalty point accumulation and redemption
  • Digital transaction facilitation
  • Community engagement features

Service Availability

Our services are primarily designed for Tier 4 and Tier 5 cities in India. Service availability may vary by location and is subject to local regulations and technical feasibility.

3. User Responsibilities

Account Creation and Security

When creating an account, you must:

  • Provide accurate and complete information
  • Maintain the security of your login credentials
  • Notify us immediately of any unauthorized access
  • Use the platform only for lawful purposes

Prohibited Activities

You agree not to:

  • Use the platform for any illegal or unauthorized purpose

Message Frequency and Opt-out

Message frequency varies based on your activity and preferences. You can:

  • Manage your communication preferences in your account settings
  • Block our WhatsApp Business number if desired

WhatsApp Business Policy Compliance

Message Content and Responsibility

6. Merchant Partner Terms

Merchant Onboarding

Local businesses joining our platform must:

  • Provide valid business registration documents
  • Comply with local business regulations
  • Maintain accurate business information
  • Honor loyalty program commitments

Merchant Responsibilities

Partner merchants agree to:

  • Provide goods and services as advertised
  • Honor loyalty points and rewards
  • Maintain appropriate business licenses
  • Comply with consumer protection laws
  • Resolve customer disputes in good faith

Platform Fees and Commissions

Merchant fees are outlined in separate merchant agreements and may include:

  • Monthly subscription fees for platform access
  • Transaction-based commissions
  • Promotional campaign fees
  • Additional service charges as applicable

7. Payment and Billing

Consumer Transactions

For consumer users:

  • Platform usage is generally free for consumers
  • Digital wallet features may have associated fees
  • All transaction fees will be clearly disclosed
  • Refunds are subject to merchant policies and applicable laws

Loyalty Points and Rewards

Loyalty points and rewards:

  • Have no cash value unless explicitly stated
  • May have expiration dates
  • Are subject to terms and conditions of participating merchants
  • Cannot be transferred between accounts without authorization

8. Intellectual Property

Our Intellectual Property

Suvihim owns all rights to:

  • The FaydaMX application and platform
  • Our logos, trademarks, and brand elements
  • Software, algorithms, and proprietary technology
  • Content, designs, and user interfaces

User Content

You retain ownership of content you create, but grant us a license to use it for providing and improving our services.

Respect for Third-Party Rights

Users must respect the intellectual property rights of others and not use our platform to infringe on copyrights, trademarks, or other proprietary rights.

9. Liability and Disclaimers

Service Disclaimers

Our services are provided "as is" and "as available." We make no warranties regarding:

  • Uninterrupted or error-free service operation
  • Complete accuracy of merchant information
  • Availability of specific merchants or offers
  • Third-party services or integrations

Limitation of Liability

To the maximum extent permitted by law, Suvihim's liability is limited to:

  • Direct damages arising from our gross negligence
  • The amount paid by you for our services in the preceding 12 months

We are not responsible for:

  • Actions or omissions of merchant partners
  • Quality of goods or services provided by merchants
  • Third-party payment processing issues
  • External website or service failures

10. Termination

Termination by You

You may terminate your account at any time by:

  • Contacting our customer support
  • Using account deletion features in the app
  • Following the account closure process

Termination by Us

We may suspend or terminate accounts for:

  • Violation of these terms and conditions
  • Suspected fraudulent activity
  • Non-compliance with applicable laws
  • Extended periods of inactivity

Effects of Termination

Upon termination:

  • Your access to our services will cease
  • Unused loyalty points may be forfeited
  • Data will be handled according to our Privacy Policy
  • Outstanding obligations remain enforceable

11. Governing Law and Dispute Resolution

These terms are governed by the laws of India. Any disputes will be subject to the jurisdiction of courts in Rajnandgaon, Chhattisgarh.
